The International Olympic Committee has asked all accredited personnel heading to the games to sign a waiver removing all liability from the IOC, the International Paralympic Committee, and the Tokyo organisers, despite them not yet being able to provide definitive countermeasures as the existing precautions may still change.
"Those organising the games will need flexibility and time.
"The 'all care no responsibility' liability waiver is standard … it is part of the litigious world we live in," he says.
But is it reasonable?
"What is reasonable – like beauty – is in the eye of the beholder.
"To the organisers and those who are insuring them, it is reasonable, if not essential.
"To those being asked to provide the release, it can appear unreasonable – especially given the level of control being exercised by the organisers."
注意義務を果たせば、免責される条項つけても、選手及び五輪関係者、業務者にワクチン接種していない以上注意義務果たしたとは言えない といわれるんじゃないの?
