ヘイトスピーチは駄目！

この米国籍のモデルさんは、中国人に捩じ込まれたら意見を変えるファッション左翼。また、ヘイトスピーチとヘイトクライムは全然違う。『ヘイト』がなくても実態的な犯罪があるもので、動機がヘイトであるものがヘイトクライム。言論の話じゃない。

Hate Speech and Hate Crime

“Hate speech” doesn’t have a legal definition under U.S. law, just as there is no legal definition for rudeness, evil ideas, unpatriotic speech, or any other kind of speech that people might condemn. Generally, however, hate speech is any form of expression through which speakers intend to vilify, humiliate, or incite hatred against a group or a class of persons.

Hate itself is not a crime. For the purposes of collecting statistics, the FBI has defined a hate crime as a “criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity.” Hate crimes, which can also encompass color, or national origin, are overt acts that can include violence against persons or property, violation of civil rights, conspiracy, or certain "true threats," or acts of intimidation. The Supreme Court has upheld laws that either criminalize these acts or impose a harsher punishment when it can be proven that the defendant targeted the victim because of the victim's race, ethnicity, identity, or beliefs.

　ヘイトスピーチは定まった定義はないが、一般に、 特定の集団を中傷、誹謗し、また、憎悪を煽ることを意図した表現。米国では規制されていない。対して、ヘイトクライムは、特定の人種、民族、信徒、性別、性的志向者、障がい者などに対する偏見に基づいた脅迫や暴力、器物破損などの犯罪。これについては米国でも合法化されている、と。


ただ、例えば、カナダなんかでは、刑法犯として罰せられる。

 Section 318:

Advocating genocide Section 318 makes it an offence to advocate or promote genocide, which is defined as killing members of an identifiable group, or inflicting conditions of life on a group which are calculated to bring about the physical destruction of the group. The offence is indictable, and carries a maximum penalty of imprisonment not exceeding five years. There is no minimum punishment.

刑法で犯罪化されている場合、ヘイトスピーチデモ、ヘイトクライムと呼ぶか、それとも、既成の犯罪について動機が特定枠の人々に対する憎悪に基づくものについて加重する場合だけをヘイトクライムと呼ぶか、そこらへん、定義の問題だろうね。

いずれにせよ、

「謹賀新年　在日韓国朝鮮人をこの世から抹殺しよう。生き残りがいたら残酷に殺して行こう」

こういうことをいうやつは非難に値する。
こうしたことを非難する声が社会で強ければよいが、そうでなければ、「〇〇は（害虫だなど人間以下の対象）だ、出ていけ、殺せ」の定型的な表現については、日本でも犯罪化しても いいとおれは思うよ。

　天安門は虐殺現場であり、ファッキューして、謝る必要はなかろうーーーそこらへんはへたれだなああ。
