米国では、人種、女性、ゲイ差別的発言の自由も保障されている

東大の准教授の差別発言が問題にされている。そもそも、あんな発言をする人を雇う大学も悪いと思うが、先日取り上げた米国のケース。

She indicated that school officials have been flooded with demands for Mr Rasmusen to be fired in recent days; a request she said the university could not – and would not – adhere to because “the First Amendment of the United States Constitution forbids us to do so”. But, she said, Mr Rasmusen would be in violation of the law and school policy if he acted upon his discriminatory views while grading or making tenure decisions. The school would investigate and address those allegations if they were raised, she added.

教授の発言は、人種差別的、女性差別的、ゲイ差別で、非難されるべきものではある。

　クビにしろ、という声が多いが、しかし、それは、できない。彼の発言は、言論の自由を保障する憲法で守られている。

　もっとも、彼が差別的見解に基づいて学生の成績や教師の在職要件について不当な評価するなど差別的行動をしたら、これは、違法であり、大学の規則にも反することになる。そのときにはしっかり調査する、と。

　発言内容は非難されるべきであるが、発言すること自体は許容されるーーここらへんの区別も大事なところである。
